By accessing or using our website, mobile application, client portal, booking system, and related services (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use our Services.

1. Acceptance of Terms

By creating an account, booking an appointment, submitting intake forms, or otherwise using our Services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), have the legal capacity to enter into these Terms, and agree to comply with all applicable federal, state, and local laws, including the laws of the State of Florida and the United States of America.

2. Description of Services

RASBERRY ANIMAL CLINIC provides veterinary medical services, including but not limited to: wellness examinations, vaccinations, dental care, surgical procedures, diagnostic imaging, emergency care, nutritional counseling, behavioral assessments, and related animal health services. Our website and portal allow clients to:

• Create and manage pet health profiles
• Schedule and manage appointments online
• Complete and submit intake and consent forms electronically
• View pet health records, vaccination schedules, weight history, and SOAP notes
• Communicate with clinic staff via messaging
• Upload and store pet-related documents and images

3. User Accounts and Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your login credentials confidential and not share them with third parties
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities conducted through your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent purposes.

4. Veterinary Services and Medical Disclaimer

Not a Substitute for Emergency Care: Our online services, including health records and messaging, are not intended to replace in-person veterinary examinations or emergency veterinary care. In case of a pet emergency, please contact us immediately at 954-436-5150 or proceed to the nearest emergency veterinary facility.

Professional Judgment: All veterinary medical decisions are made by licensed veterinarians in accordance with the Florida Veterinary Practice Act (Chapter 474, Florida Statutes) and the rules of the Florida Board of Veterinary Medicine. Treatment recommendations are based on professional clinical judgment and may vary from general information provided online.

No Guarantees: While we strive to provide the highest quality veterinary care, we cannot guarantee specific outcomes from any treatment, procedure, or service. All veterinary care carries inherent risks.

5. Appointment Scheduling and Cancellation Policy

• Appointments booked through our portal are confirmed upon receipt of a confirmation notification.
• We request a minimum of 24 hours' notice for appointment cancellations or rescheduling.
• Repeated no-shows or late cancellations may result in a cancellation fee or restriction of online booking privileges.
• We reserve the right to cancel or reschedule appointments due to emergencies, staffing, or operational needs.

6. Consent to Treatment

By completing our electronic intake and consent forms, you authorize RASBERRY ANIMAL CLINIC to:

• Perform examinations, diagnostic procedures, and treatments as deemed medically necessary by our veterinary staff
• Administer emergency treatment up to the threshold specified in your consent form if you cannot be reached
• Provide appropriate medical care in the best interest of your animal's health and welfare

You may withdraw consent at any time in writing, subject to the limitations of ongoing treatments.

7. Electronic Signatures and Records

In accordance with the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and the Florida Uniform Electronic Transaction Act (Florida Statutes § 668.50), you acknowledge and agree that:

• Electronic signatures submitted through our intake forms constitute valid, legally binding signatures
• Electronic records have the same legal effect as paper records
• You consent to receiving documents, notices, and communications in electronic form

8. Payment Terms

• Payment is due at the time of service unless prior arrangements have been made.
• We accept various forms of payment as displayed at our facility and on our website.
• Estimated costs are provided as a courtesy and may change based on actual services rendered.
• Outstanding balances may be subject to collection proceedings and applicable interest under Florida law.
• You are responsible for all costs associated with the treatment of your animal(s).

9. Intellectual Property

All content on our website and portal, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of RASBERRY ANIMAL CLINIC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

• Our name, logo, and all related marks are trademarks of RASBERRY ANIMAL CLINIC.
• You may not reproduce, distribute, modify, display, or create derivative works from any content without our prior written consent.
• User-submitted content (photos, pet information) remains your property, but you grant us a non-exclusive license to use it for providing our Services and, where you have provided consent, for educational or marketing purposes.

10. User Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to any part of the Services or other systems
• Impersonate any person or entity or misrepresent your affiliation
• Harass, abuse, or threaten our staff or other users

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING FLORIDA LAW:

• RASBERRY ANIMAL CLINIC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
• Our total liability for any claim arising from or relating to these Terms or the Services shall not exceed the amount you paid to us for the specific service giving rise to the claim.
• We are not liable for damages arising from interruptions in service, data loss, errors in online scheduling, or reliance on information provided through the portal.

12. Indemnification

You agree to indemnify, defend, and hold harmless RASBERRY ANIMAL CLINIC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of or access to the Services

• Your violation of any third-party rights
• Any content you submit or transmit through the Services

13. Governing Law and Dispute Resolution

• Subject to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida, for any matters not subject to arbitration

You waive any right to participate in a class action lawsuit or class-wide arbitration against RASBERRY ANIMAL CLINIC.
